By using the River Place Residences website you agree to our Terms of Use and Privacy Policy, which set out your rights and obligations under Australian law.

These Terms of Use govern access to and use of the River Place website, resident portal, online forms, email communications, and any related digital services, features, content, and functionality made available by River Place Management (“River Place”, “we”, “us” or “our”). By accessing, browsing, submitting information through, registering for, or using any part of our website or resident portal, you acknowledge that you have read and understood these Terms of Use and agree to be bound by them. If you do not agree to these Terms of Use, you must not use the website or resident portal.
These Terms of Use are intended to regulate the use of River Place’s digital platforms and online services only. They do not replace, vary, or override any lease, occupancy agreement, building by-laws, management agreement, work order, contractor agreement, policy, or other legally binding arrangement that may separately apply between you and River Place or any related party. To the extent of any inconsistency, those separate documents will prevail in relation to the subject matter they govern.
River Place may update these Terms of Use from time to time to reflect changes in law, technology, systems, services, security requirements, or business operations. The current version will be published on the website with the revised “Last Updated” date. By continuing to access or use the website, resident portal, or related online services after updated terms are published, you agree to the updated Terms of Use to the extent permitted by law. Where appropriate, River Place may also notify users of material changes by email, portal notification, or other reasonable means.
The website and resident portal are provided to enable users to obtain information about River Place, communicate with management or reception, submit enquiries and requests, access resident-related functions, receive building or community updates, manage certain account or service interactions, and use other features made available by River Place from time to time. You must use the website and portal only for lawful purposes and only in a way that is consistent with these Terms of Use, our Privacy Policy, and any other policies or notices displayed on the site or communicated to you. Nothing on the website constitutes legal, financial, tenancy, strata, property, security, or emergency advice, and website content is provided for general informational purposes unless expressly stated otherwise.
You must not use the website, portal, or any related systems in a way that is unlawful, fraudulent, misleading, defamatory, abusive, harassing, threatening, discriminatory, invasive of privacy, or otherwise objectionable. You must not upload, submit, transmit, or otherwise make available any material that is false, inaccurate, infringing, malicious, harmful, obscene, offensive, or likely to interfere with the operation, integrity, security, or reputation of River Place or its systems. You must not attempt to gain unauthorised access to the portal, accounts, servers, data, networks, APIs, code, databases, forms, or any other connected system or infrastructure, and you must not test, probe, scan, reverse engineer, scrape, copy, disrupt, overload, circumvent security, introduce malware, or use bots or automated means except where expressly permitted in writing by River Place.
If you create or are given access to a resident portal account, you are responsible for ensuring that all registration and account information you provide is accurate, current, complete, and not misleading. You are responsible for maintaining the confidentiality and security of your login credentials and for all activities carried out using your account, except to the extent caused by River Place’s own breach, negligence, or failure to implement reasonable security measures. You must notify River Place promptly if you become aware of any unauthorised access, suspected compromise, misuse of credentials, suspicious activity, or other security concern affecting your account or the portal. River Place may suspend, restrict, or require re-verification of an account where it reasonably considers this necessary for identity verification, security, system integrity, fraud prevention, legal compliance, or operational reasons.
You must ensure that all information, documents, requests, instructions, payment details, maintenance reports, forms, and other content submitted through the website or resident portal are accurate, complete, lawful, and submitted by a person authorised to do so. River Place is entitled to rely on information submitted through the portal or website unless it has actual knowledge that the information is inaccurate, unauthorised, or unreliable. River Place is not responsible for delays, losses, service issues, or adverse outcomes arising from incomplete, incorrect, outdated, misleading, or unauthorised information submitted by users.
The website and resident portal may allow users to submit forms, enquiries, maintenance requests, bookings, contact updates, applications, documents, feedback, or other communications. Submission of a request through the website or portal does not in itself constitute acceptance, approval, confirmation, legal notice, or binding agreement by River Place unless River Place expressly confirms that outcome in writing. River Place may decline, defer, verify, request more information about, or refuse to act on any submission where it reasonably considers this necessary for safety, identity verification, process compliance, legal compliance, operational requirements, or risk management.
The website and resident portal are not emergency services and must not be relied on for urgent, life-threatening, security-critical, or time-sensitive emergency communications. If there is an emergency, users must contact the appropriate emergency services or other designated emergency contact channels immediately. River Place does not warrant that maintenance requests, messages, alerts, portal notifications, or email communications submitted through the website or portal will be monitored in real time or responded to within any particular timeframe unless expressly stated otherwise.
River Place may publish building information, notices, announcements, service information, amenity information, articles, photographs, branding, logos, designs, layouts, graphics, documents, policies, downloads, and other content through its digital platforms. Unless otherwise indicated, all intellectual property rights in that material are owned by or licensed to River Place. You may view, download, or print limited extracts for your personal, non-commercial, and internal informational use only, provided you do not remove any copyright, trade mark, or proprietary notices and do not modify, reproduce, republish, distribute, exploit, frame, mirror, adapt, or commercialise the material without River Place’s prior written consent. Nothing in these Terms of Use transfers ownership of intellectual property rights to you.
If you submit content, documents, comments, photos, forms, feedback, suggestions, maintenance requests, incident reports, reviews, or other materials to River Place through the website, portal, or related channels, you represent that you are entitled to submit that material and that it does not infringe any person’s rights or breach any law. You grant River Place a non-exclusive, royalty-free, revocable, worldwide licence to use, store, copy, transmit, reproduce, adapt, and otherwise deal with that material to the extent reasonably necessary to operate the website and portal, provide services, respond to your request, administer the building or community, improve our operations, meet legal obligations, resolve disputes, or protect our legitimate interests. River Place may remove or decline to publish user-submitted material at its discretion.
River Place may provide access to online payments, payment links, gateway integrations, portal billing functions, or related financial transaction tools through third-party providers. Any such payment services may be subject to additional third-party terms, conditions, processing rules, and security requirements. River Place does not control third-party payment platforms and is not responsible for the independent acts, omissions, downtime, or security failures of those providers, although River Place will remain responsible for its own legal obligations that cannot be excluded. Users are responsible for ensuring that payment information submitted is accurate and authorised and for reviewing any applicable fees, terms, and confirmations before proceeding.
River Place may use email, SMS, portal notifications, or other electronic communications to send account-related, operational, safety, service, billing, building, or community communications. Where River Place sends commercial electronic messages for marketing or promotional purposes, those communications will be managed in accordance with applicable Australian spam laws, including sender identification and unsubscribe requirements. Operational or service-related communications that are necessary for account administration, portal access, security, building management, billing, legal compliance, or service delivery may continue even where a user has opted out of marketing communications.
Your use of the website and resident portal may involve the collection, storage, use, and disclosure of personal information. River Place handles personal information in accordance with its Privacy Policy and applicable privacy laws. River Place may also use cookies, analytics, tracking pixels, access logs, and similar technologies to operate, secure, improve, and measure the performance of its website, portal, communications, and services. Australian privacy law requires APP entities to clearly explain how personal information is handled and, at or before collection, to notify individuals of certain matters relating to collection.
River Place may rely on third-party systems, software, infrastructure, communications providers, analytics services, cloud services, and resident portal technologies to make the website and portal available.
While River Place will take reasonable steps to maintain availability, security, and functionality, it does not guarantee that the website, portal, or any feature will always be available, uninterrupted, secure, error-free, compatible with every device or browser, or free from delay, corruption, loss, or unauthorised interference. Scheduled maintenance, emergency maintenance, system upgrades, outages, third-party failures, cyber events, internet disruptions, and operational issues may affect availability.
To the maximum extent permitted by law, the website, portal, and all content are provided on an “as is” and “as available” basis. River Place does not warrant that content is complete, current, suitable for every purpose, or free from typographical, technical, or factual error, although it may update information at any time without notice.
Users are responsible for independently assessing the suitability, accuracy, and relevance of any information, downloads, notices, announcements, or tools available through the website or portal before acting on them.
Nothing in these Terms of Use excludes, restricts, or modifies any consumer guarantee, statutory right, remedy, condition, or warranty that cannot lawfully be excluded, restricted, or modified under the Australian Consumer Law or any other applicable law. Where a statutory guarantee or other non-excludable right applies, River Place’s liability is limited only to the maximum extent permitted by law.
Australian consumer law gives consumers rights and guarantees that businesses cannot exclude, and unfair terms in standard form contracts with consumers or small businesses can be void and unlawful.
Subject to the paragraph above, and to the maximum extent permitted by law, River Place excludes liability for any indirect, incidental, consequential, exemplary, special, or punitive loss, including loss of profits, revenue, opportunity, goodwill, data, expected savings, or business interruption, arising out of or in connection with the use of, inability to use, or reliance on the website, portal, content, communications, or linked services. Subject again to non-excludable rights, River Place’s aggregate liability for direct loss arising from the website or portal will be limited to the amount paid by you, if any, for the relevant online service giving rise to the claim, or, if no fee was paid, a reasonable resupply of the relevant service or equivalent remedy as determined by River Place to the extent permitted by law.
You agree to indemnify and hold harmless River Place, its officers, employees, contractors, agents, and related bodies corporate from and against claims, losses, damages, liabilities, costs, and expenses, including reasonable legal costs, arising out of or in connection with your unlawful use of the website or portal, your breach of these Terms of Use, your infringement of another person’s rights, your misuse of credentials, or your submission of false, misleading, unauthorised, or infringing content, except to the extent caused or contributed to by River Place’s own breach, negligence, or unlawful conduct.
This clause is intended to operate only to the extent permitted by law and must not be interpreted so broadly as to create an unfair or unenforceable standard form term. Standard form contract terms that are unfair may be void under the Australian Consumer Law.
River Place may suspend, restrict, monitor, remove access to, or terminate access to the website, resident portal, or any user account at any time where it reasonably considers this necessary for security, legal compliance, fraud prevention, maintenance, risk management, identity verification, suspected misuse, breach of these Terms of Use, protection of residents or staff, protection of confidential information, or the orderly operation of its systems and services. Where appropriate and practicable, River Place may notify the affected user and provide an opportunity to address the issue, but it is not obliged to do so where immediate action is reasonably necessary.
The website, portal, and digital communications may contain links to third-party websites, platforms, booking engines, payment providers, utility providers, maps, forms, or services. Those third-party services are not under River Place’s control, and River Place is not responsible for their content, availability, security, privacy practices, accuracy, terms, or performance. A link does not imply endorsement, approval, or affiliation unless expressly stated. Users access third-party services at their own risk and should review the relevant third-party terms and privacy policies.
If any provision of these Terms of Use is found to be invalid, illegal, void, or unenforceable by a court or tribunal, that provision will be severed or read down to the minimum extent necessary, and the remainder of the Terms of Use will continue in full force and effect to the extent capable of operating without the invalid provision. Under Australian consumer law, a term found to be unfair in a standard form contract is void while the remainder of the contract may continue if it can operate without that term.
Any waiver by River Place of a breach of these Terms of Use will not operate as a waiver of any other breach. A delay or failure by River Place to enforce a right does not waive that right. River Place’s rights and remedies under these Terms of Use are cumulative and do not exclude any rights or remedies available at law.
These Terms of Use are governed by the laws of Queensland, Australia. You submit to the non-exclusive jurisdiction of the courts of Queensland and any courts competent to hear appeals from those courts. If any mandatory law gives you the right to bring proceedings elsewhere or provides non-excludable protections, nothing in this clause limits those rights.
