These Terms of Use govern access to and use of the website operated for the River Place Residences community in Brisbane (the “Site”). By visiting, browsing or using the Site, you acknowledge that you have read, understood and agree to be bound by these Terms of Use and by our Privacy Policy. If you do not agree, you must not use the Site. Additional terms may apply where the Site links to resident-only platforms such as a booking or resident hub; your use of any such platform is subject to its own terms and privacy notices in addition to these Terms.

The content on the Site is provided for general information only. It does not constitute legal, financial or real-estate advice, and it is not an offer, representation or warranty regarding the availability, pricing, views, dimensions, inclusions or suitability of any residence or amenity. Any tenancy, licence, service or facility booking is subject to separate application, assessment, building by-laws and written agreement. While reasonable efforts are made to ensure accuracy, images, floorplans and descriptions may be indicative of similar layouts and finishes; areas and outlooks can vary between apartments; and availability dates are estimates that may change. You should rely on the final lease documentation, condition reports, house rules and body corporate by-laws rather than the Site.

The Site may provide links to or integrations with third-party services, including a resident hub, booking system, payment processor, mapping service or analytics provider. These services are operated by third parties and are not controlled by River Place Residences. Your use of them is governed by their terms and privacy policies. River Place Residences is not responsible for the acts, omissions, availability, security, accuracy or performance of third-party services, and you access them at your own risk.

Certain areas of the Site may be available only to residents and authorised users who are at least eighteen years of age. You are responsible for maintaining the confidentiality of your login credentials and for all activity conducted under your account. If you believe your account has been compromised, you must notify River Place Residences promptly so that appropriate steps can be taken to protect the security of the Site and your information.

You must use the Site lawfully and in good faith. You must not attempt to gain unauthorised access to any part of the Site, test or circumvent its security, interfere with its operation, introduce malware, scrape or harvest data without written consent, upload or transmit material that is unlawful, defamatory, misleading, offensive or infringing, or impersonate any person or misrepresent your tenancy status or authority. River Place Residences may suspend or terminate access to the Site, including access to member-only areas, if it reasonably believes you have breached these Terms, created risk to users or systems, or used the Site unlawfully.

If you make an enquiry, submit a form, request maintenance or book an amenity through the Site or a linked platform, your request is subject to availability, operational requirements, applicable fees and any cancellation or modification policies stated at the time of booking. Building by-laws, house rules and reasonable instructions from building management govern the physical use of facilities and prevail in the event of any inconsistency with Site content. Management may amend, reschedule or cancel bookings where required for maintenance, safety, compliance or other operational reasons, acting reasonably.

All intellectual property in the Site and its content—including text, graphics, photographs, video, code, design elements and trade marks—is owned by River Place Residences or its licensors and is protected by the Copyright Act 1968 (Cth) and other applicable laws. You are granted a limited, revocable, non-transferable licence to access and view the Site for personal, non-commercial purposes. You must not copy, adapt, publish, frame, distribute, perform, communicate, reverse-engineer or otherwise exploit any part of the Site without prior written consent, except as permitted by law.

Where you submit content to the Site, including enquiries, reviews, feedback or other materials, you represent and warrant that you have the right to provide that content, that it is accurate and lawful, and that it does not infringe the rights of any person. You grant River Place Residences a worldwide, royalty-free licence to use, reproduce, modify and communicate that content for the purpose of operating, maintaining and improving the Site and resident services. River Place Residences may remove or decline to publish content that it considers, acting reasonably, to breach these Terms or applicable law.

River Place Residences handles personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. Please refer to the Privacy Policy for details about the collection, use, storage and disclosure of personal information, the use of cookies and analytics, and your rights to access and correct your information. By providing contact details through the Site, you consent to receiving essential service communications such as booking confirmations, building notices and security updates. Any direct marketing communications will comply with the Spam Act 2003 (Cth) and will include a functional unsubscribe facility.

Nothing in these Terms excludes, restricts or modifies any rights and remedies that cannot be excluded under the Australian Consumer Law in Schedule 2 of the Competition and Consumer Act 2010 (Cth). Subject to those non-excludable rights, the Site is provided “as is” and “as available”. River Place Residences does not guarantee that access will be uninterrupted, timely, secure or error-free, or that content will always be current, complete or suitable for your purposes. You are responsible for verifying information before relying on it and for implementing appropriate security measures, including anti-virus protection and regular backups, when using the Site.

To the maximum extent permitted by law, River Place Residences’ liability to you arising out of or in connection with the Site and these Terms is limited, at its option, to resupplying the relevant services or paying the cost of having those services resupplied. Where a monetary cap is permitted, the aggregate liability in any twelve-month period will not exceed AUD $100 or, if you have paid fees directly to River Place Residences for Site-related services in that period, the total of those fees. River Place Residences will not be liable for any indirect, special or consequential loss, or for loss of profits, revenue, goodwill, data, opportunity or anticipated savings, and is not responsible for failures of third-party platforms.

You agree to indemnify and hold harmless River Place Residences and its officers, employees and contractors from and against all loss, liability, damage, cost and expense (including reasonable legal costs) arising from your breach of these Terms, your misuse of the Site or your infringement of any law or third-party rights. This indemnity is in addition to any other rights and remedies available at law.

River Place Residences takes reasonable steps to keep the Site secure but cannot guarantee that it will be free from vulnerabilities, errors or malicious code. Access may be suspended, withdrawn or restricted at any time for maintenance, security or operational reasons. River Place Residences will endeavour to minimise disruption where reasonably practicable. Electronic communications and transactions conducted through the Site are recognised under the Electronic Transactions Act 1999 (Cth) and the Electronic Transactions (Queensland) Act 2001 (Qld).

If any provision of these Terms is found to be invalid, illegal or unenforceable, that provision is severed and the remainder continues in full force. Headings are for convenience only and do not affect interpretation. Unless the context requires otherwise, words in the singular include the plural and vice versa, and “including” is not exhaustive.

These Terms, together with the Privacy Policy and any additional terms that expressly apply to specific features, constitute the entire agreement between you and River Place Residences regarding use of the Site. They are governed by the laws of Queensland, Australia. You irrevocably submit to the exclusive jurisdiction of the courts of Queensland and of the Commonwealth of Australia in respect of any dispute arising out of or in connection with the Site or these Terms.
